A common reason for valuations is that taxpayers are charged a disproportionately high tax burden by the tax office when acquiring a property, through inheritance or as a gift. In such cases, an appraisal can often help to contest the tax assessment and prove a lower market value. However, it is strongly recommended that you seek advice from a tax consultant. The information provided on this website does not constitute tax advice and cannot replace it.
Experts certified in accordance with DIN EN ISO/IEC 17024 have already been placed on an equal footing with publicly appointed and sworn appraisers in the area of providing such appraisals, which are intended to prove the lower fair market value.
The Federal Ministry of Finance (BMF) has introduced an amendment to Section 198 of the Valuation Act (BewG), which came into force on 23.07.2021. The legislator has clarified that appraisals by DIN EN ISO/IEC 17024-certified experts can be recognized as evidence of a lower fair market value not only by the tax authorities but also by tax courts.
